Please read before requesting an appointment.

Submitting a website project brief does not reserve a date or create a contract. A contract is formed only when Atlas Blinds Ltd issues a written quotation or order confirmation and the client accepts it in the way stated. Consumer statutory rights are not restricted by these terms.

1. Contract and documents

These terms apply to installation, survey, measuring, remedial and related services supplied by Atlas Blinds Ltd (“Atlas”, “we”, “us”), company number 13866301, registered in England and Wales. “Client” means the person or business instructing Atlas. A “Consumer” is an individual acting mainly outside their trade or profession; a “Trade Client” is any other client.

The contract consists of the accepted quotation or order confirmation (the “Project Schedule”), these terms, any agreed drawings or product schedule, and any written variation. If documents conflict, the Project Schedule takes priority, followed by an agreed variation, then these terms.

A quotation is valid for the period stated on it, or for 30 days if no period is stated. A website, telephone or WhatsApp enquiry is an invitation to discuss work only. No appointment, price or start date is confirmed until Atlas confirms it in writing and any stated deposit or booking requirement is met.

2. Scope and changes

Atlas will provide only the services, products, quantities, locations and responsibilities stated in the Project Schedule, using reasonable care and skill. Work outside that scope—including additional units, return visits, making good, decoration, specialist access, replacement parts, electrical work or programming—is excluded unless agreed in writing.

If site conditions, missing information or client instructions change the work, Atlas will explain the effect and seek agreement to a fair change in price, time or method before continuing where reasonably practicable. Atlas may pause work while a variation or safety issue is resolved.

Atlas may use suitably competent employees or subcontractors and remains responsible for the contracted services.

3. Products and measurements

Client- or supplier-supplied products

Unless the Project Schedule says Atlas is supplying or specifying them, the client or its supplier is responsible for product choice, specification, manufacturing accuracy, compatibility, instructions and providing all complete, undamaged components. Atlas may refuse to fit items that are damaged, incomplete, unsafe, incorrectly sized or unsuitable for the site.

Atlas is not responsible for an inherent product defect, manufacturer error, incomplete component set, normal fabric behaviour, colour variation, product performance or warranty issue that Atlas did not cause. This does not affect liability for damage caused by Atlas failing to use reasonable care and skill.

Measurements

Where Atlas is expressly contracted to measure, it will do so with reasonable care and skill based on the accessible site condition at that time. Where dimensions are supplied by the client or another party, that party remains responsible for their accuracy. Alterations after measuring, concealed features and tolerances outside Atlas’s control may require a variation.

4. Site and client duties

The client must provide, by the agreed time:

  • accurate site, product, access and programme information;
  • a safe, clear and lawful working area, with children, pets, valuables and obstructing furniture kept away;
  • reasonable parking, permits, loading access and any building-management authorisation;
  • an authorised adult or site representative who can approve positioning and reasonable decisions;
  • all landlord, freeholder, planning, building-management and other permissions;
  • details or plans for concealed pipes, cables, alarms, underfloor heating, fragile finishes and other known hazards; and
  • appropriate power and specialist trades where the agreed scope requires them.

Atlas will make a reasonable visual assessment but does not carry out an intrusive structural survey unless expressly agreed. Hidden voids, weak or crumbling plaster, reinforced concrete, steel lintels, concealed services, unstable surfaces, access restrictions or other unknown conditions may require different fixings, specialist advice, a variation or a return visit.

Reasonable drilling and fixing can create minor dust, holes or marking. Atlas will take reasonable care, but making good, filling and decoration are excluded unless stated in the Project Schedule. The client must disclose unusually valuable, delicate or newly finished surfaces before work starts.

5. Safety and asbestos

Atlas may stop, postpone or refuse work where it reasonably believes conditions, access, equipment, instructions or materials are unsafe. This is not a breach of contract, and the parties will agree a safe next step.

The client or relevant dutyholder must disclose known or suspected asbestos and provide the asbestos register, survey or other suitable information for any area that may be disturbed. This is especially important in non-domestic premises, common parts and buildings constructed or refurbished before 2000. Atlas does not undertake asbestos work. If suspect material is found, work will stop until a competent asbestos professional confirms that work can safely continue.

6. Motorised systems and electrical responsibility

Atlas’s responsibility for motorised blinds, curtains or tracks is limited to the physical installation, pairing, basic testing or commissioning coordination expressly stated in the Project Schedule. Atlas does not carry out mains electrical work.

The client must arrange any required fixed wiring, fused spurs, power supplies, controls, network access, specialist programming, smart-home integration and electrical certification through appropriately competent specialists unless the Project Schedule expressly allocates a specific task to Atlas. Atlas is not responsible for third-party software, signal coverage, power quality, manufacturer outages or integrations outside its agreed work.

7. Dates, price and payment

Atlas will use reasonable efforts to meet agreed dates. Unless the Project Schedule expressly says a date is guaranteed, dates are estimates and may change because of product availability, supplier delay, site readiness, unsafe weather or access, other trades, illness or events beyond reasonable control. Atlas will communicate material delays and arrange a reasonable alternative.

Unless the Project Schedule states a different stage plan, Atlas requires an advance payment equal to 50% of the agreed project price. The remaining 50% is normally due on completion or at the stage stated in the Project Schedule. Atlas is not currently VAT registered, so VAT is not added unless the Project Schedule expressly states that Atlas’s VAT status has changed.

The client must expressly accept the quotation, scope, exclusions and applicable version of these terms before payment. Successful payment of the 50% advance is additional evidence of that acceptance. Payment does not by itself guarantee or reserve an appointment date: the date is secured only when Atlas confirms it in writing.

The advance payment is not automatically described as non-refundable. If the client cancels, Atlas will apply the statutory Consumer cancellation rules where relevant and may otherwise deduct or recover only reasonable evidenced losses, work performed, committed costs and reserved capacity that Atlas cannot reasonably avoid. Any refund due will be calculated after those matters are assessed. Atlas will not impose a penalty.

Atlas will not charge a Consumer for additional work without agreement. Trade Clients must pay in accordance with the Project Schedule; statutory rights relating to late commercial payment are preserved.

If Atlas cannot work because the site, product, access or authorised representative is not ready as agreed, it may charge a reasonable amount for demonstrable wasted time, travel, reserved capacity or additional work, after taking reasonable steps to reduce the loss.

8. Cancellation and rescheduling

Consumers

Where a Consumer contract is made online, by telephone or away from Atlas’s business premises, the Consumer will usually have 14 days from the day after the contract is made to cancel without giving a reason. Full instructions and a model form are on the Consumer Cancellation Notice. Statutory exceptions and rights apply as required by law.

Atlas will begin services during that 14-day period only after receiving a separate express written request. If the Consumer then cancels after work has started, Atlas may charge a proportionate amount for services supplied up to cancellation. If the service is fully performed after the Consumer’s express request and acknowledgment, the cancellation right may end. The website terms checkbox is not that separate request.

Trade Clients and cancellation after the statutory period

Trade Clients do not receive consumer cancellation rights. Where a client cancels or reschedules outside an applicable statutory right, Atlas may recover reasonable, evidenced losses that cannot be avoided, including committed costs, reserved capacity and work already performed. Atlas will take reasonable steps to reduce those losses and will not impose a penalty.

9. Completion, inspection and concerns

The client should inspect the work when reasonably possible and notify Atlas promptly of visible concerns so they can be recorded and addressed. Notice within seven days is helpful for visible snagging, but this does not remove a Consumer’s statutory rights or prevent a later claim for a defect that could not reasonably have been identified earlier.

If Atlas has not provided the contracted service with reasonable care and skill, it will provide the remedy required by applicable law. Any additional workmanship warranty will be stated in the Project Schedule. Product and manufacturer warranties remain the responsibility of the relevant supplier unless Atlas supplied the product.

Complaints should be sent to mj@atlasblinds.co.uk with the project address, photographs and a clear description. Atlas will acknowledge the concern and seek a practical resolution.

10. Liability and insurance

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot legally be excluded, or any other liability that law does not permit Atlas to exclude.

Consumers

Atlas does not exclude liability for foreseeable loss or damage caused by its breach or negligence. Atlas is not responsible for loss that was not foreseeable, for business loss suffered by a Consumer, or for a product, instruction, defect, hidden condition or third-party failure that Atlas did not cause.

Trade Clients

So far as law permits, Atlas is not liable to a Trade Client for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or anticipated saving. Any project-specific aggregate liability cap must be stated in the Project Schedule and will apply only so far as it is fair, reasonable and legally enforceable. The client must take reasonable steps to reduce avoidable loss.

Atlas maintains public liability insurance appropriate to its operations. Evidence can be made available for relevant trade projects on request. Insurance does not create liability beyond the contract or applicable law.

11. General terms

Atlas processes personal information as described in its Privacy Notice. If part of the contract is invalid or unenforceable, the remaining parts continue. A delay in enforcing a right is not a waiver. No person other than Atlas and the client has rights under the contract, except where law requires otherwise.

The contract is governed by the law of England and Wales. The courts of England and Wales have jurisdiction, but a Consumer keeps any mandatory right to bring proceedings in the part of the UK where they live.

Project Schedule checklist

Each accepted quotation or order confirmation should identify:

  • client name and whether Consumer or Trade Client;
  • project address, contact and authorised site representative;
  • products, quantities, supplier and who is responsible for specification and measurement;
  • survey, installation, testing, programming and handover scope;
  • fixing surfaces, access equipment, parking, working hours and site restrictions;
  • motorisation, electrical and third-party specialist responsibilities;
  • price, VAT treatment, deposit, payment stages and validity period;
  • target dates, dependencies, exclusions and agreed variations;
  • the version of these terms supplied to the client; and
  • where relevant, the Consumer Cancellation Notice and a separate early-start request.

Consumer early-start request

This must be a separate, un-ticked and express instruction after the contract is agreed:

“I request Atlas Blinds Ltd to begin the services before my 14-day cancellation period expires. I understand that if I cancel after work starts, I must pay a proportionate amount for services supplied up to cancellation. I understand that if the service is fully performed, my right to cancel may end once performance is complete.”
